HOW WE CAN HELP

If you are a Canadian citizen or a permanent resident, you may be able to sponsor your spouse, conjugal or common-law partner, child (including an adopted child), parents or other eligible relative to become a permanent resident under one of the family classes. Permanent resident status will allow your family member to live, study and work in Canada.

Given IRCC’s rigorous requirements, it is important to provide a complete package at the initial submission to avoid delays or return of an incomplete application package. Our extensive experience in dealing with family sponsorship allows us to assist clients with preparing complete and accurate applications to sponsor their loved-ones to Canada. To better serve our clients, we provide notarization, certified translation of foreign documents and true copies verification services for an additional fee.

5. To communicate with IRCC
We communicate with IRCC, and Canadian Border Services Agency (CBSA) on your behalf, including but not limited to, corresponding through phone calls, email, and mail; complying with immigration officer requests in a timely manner; tracking application progress; and filling for changes of your circumstances.

6. Prepare you for immigration interview
We consider preparation for spousal sponsorship interview to be absolutely essential.  As such, our consultants will take the time to do a preparatory session, where we will pose the kind of questions that the claimant can expect to receive from the officer at the interview.  This practice both assists with reviewing the essential elements of our client’s application, provides reassurance and increases their confidence for their big day at the interview.

Family Sponsorship Eligibility 

Who Can Be A Sponsor
You can sponsor someone to become a permanent resident if you are, 
  • 18 years or older,
  • a Canadian citizen or permanent resident,
  • living in Canada (if you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when your sponsored relative becomes a permanent resident. You can’t sponsor someone if you’re a permanent resident living outside of Canada), and
  • Willing to sign an undertaking agreement (If sponsoring a spouse or partner or a child over 19 years of age, this financial commitment lasts for 3 years from the date they become a permanent resident. For a dependent child under 22 years of age, it lasts for 10 years or until the child turns 25 (whichever comes first).

Who Can Not Be A Sponsor
  • previously sponsored someone and did not pay back any social assistance that they received while the undertaking was in place.
  • are in default on an immigration loan or a performance bond
  • did not pay court-ordered alimony or child support
  • have declared bankruptcy which has not been discharged
  • were convicted of 
    • an offence of a sexual nature,
    • a violent crime,
    • an offence against a relative that caused bodily harm or
    • threatened or attempted to commit any of the above offences—depending on the nature of the offence, how long ago it happened and if you received a pardon
  • are restricted by five-year Sponsorship Bar
  • are under a removal order,
  • are in a penitentiary, jail, reformatory or prison,
  • have a spousal sponsorship application currently in process and haven’t received a decision.

Sponsor Your Spouse, or Common-law Partner
You can sponsor a spouse, common-law or conjugal partner, or dependent child to immigrate to Canada whether they live inside or outside Canada.

Spouse in-Canada Class
If your spouse or common-law partner are already living with you in Canada, you have the option to apply under the Spouse or Common-Law Partner in Canada class​. This class has an advantage: your spouse/partner could apply for an open work permit if he or she has valid immigration status; It also has a disadvantage: no right to appeal a negative decision to the Immigration Appeal Division. ​We can advise you on choosing the appropriate sponsorship class that best suits your particular situation and immigration needs. 

Spouse Open Work Permit 
If your spouse or partner is living in Canada with you and is applying under Spouse In Canada Class, our firm can help your spouse to obtain an open work permit so that he/she is able to work while the application is being processed.  

Processing Time for Spousal Sponsorship Applications
Immigration, Refugees and Citizenship Canada provides estimates of the processing time for your sponsorship application.The current processing time for spousal sponsorship application is 12 months. The actual processing time of each application varies according to a number of factors.

Who Can Be Sponsored

Spouse
  • legally married
  • can be either sex

Common-law Partner
  • isn’t legally married 
  • can be either sex
  • has been living together for at least 12 consecutive months in a conjugal relationship, without any long periods apart

Conjugal Partner
  • isn’t legally married or in a common-law relationship
  • can be either sex
  • has been in a relationship for at least 1 year
  • lives outside Canada
  • can't live with each other in the country of residence or get married because of significant legal and immigration reasons such as
    • marital status (for example, one party is still married to someone else in a country where divorce isn’t possible)
    • sexual orientation (for example, same-sex relationship, and same-sex relationships are not accepted, or is illegal where they live),
    • persecution (for example, your relationship is between different religious groups which is not accepted and they may be punished legally or socially)
